The starting point for responding to China's materials export controls is understanding what kind of restriction they actually are. Most measures — including those on scandium — are not embargoes but case-by-case licensing regimes. Supply is not sealed off; it has to pass review. Once you understand that structure, procurement can be designed to improve the odds of license approval and to spread risk. This article lays out five practical procurement strategies for a licensing environment, plus a vendor due-diligence checklist.
Start by Understanding the Licensing Structure
Under a licensing regime, authorities review each export shipment individually. Two practical implications follow, and they form the backbone of any sourcing strategy.
First, allocation is not neutral. Suppliers bear the burden of obtaining licenses, and an exporter with limited licensing bandwidth tends to spend it on its largest customers first — an observed commercial pattern rather than a published size-based queue. Small spot contracts are correspondingly the most exposed to supply interruption.
Second, end use is central to review. MOFCOM's stated policy is denial for military end use; dual-use applications with a plausible military pathway draw the heaviest scrutiny, while clearly civilian uses are selectively approved on the basis of end-user and end-use documentation. Strategy 1: Design for License Approval Through End-Use Documentation
Paperwork is the part of the licensing process the buyer actually controls — not a lever on the decision itself. Outcomes turn on the end user's identity, the exporter's standing with MOFCOM, and the state of bilateral relations at least as much as on the quality of the file. Prepare the package anyway, and prepare it early: end-user statements, use descriptions, and a clear account of the finished product's civilian application. This matters most for items with potential defense concerns, such as scandium: presenting an unambiguous civilian application like energy or fuel cells in documentation from the outset works in your favor. Deferring this preparation until after the contract is signed simply adds to lead time.
Strategy 2: Dual-Source the Supply
Relying on a single controlled-jurisdiction supplier means a license delay stops the line once your inventory buffer is exhausted — which is why buffer sizing and dual sourcing are designed together rather than as alternatives. The common structure is to run two tracks in parallel:
- Controlled-jurisdiction line (license track): Keep a price-competitive Chinese supplier, but operate on the assumption of case-by-case licensing.
- Non-China premium line: Secure a parallel supplier in Japan, the US, or Korea. The unit price is higher, but removing exposure to Chinese licensing provides a buffer when licenses are delayed. Two qualifications. These are not uncontrolled jurisdictions: the US administers the EAR (and ITAR for defense articles), scandium alloys and fuel-cell materials can carry ECCNs, and re-export obligations follow US-origin goods worldwide, while Japan's METI catch-all controls can reach the same materials — so classification has to be confirmed on that side too. And a Japanese or Korean refiner may itself run on Chinese Sc₂O₃, so ask for the feedstock origin before treating the track as China-free (see Strategy 5).

Strategy 3: Defend Yourself Through the Contract
The risk that a license is not granted should be written into the contract in advance. The key device is an Export License Contingency clause, and its trigger has to be a deadline rather than a refusal:
If the export license has not issued within N days of contract signature, either party may terminate the contract, and the seller refunds any advance payment within M days.
Conditioning the trigger on the license being "not granted" is the common drafting mistake. MOFCOM outcomes are frequently indefinite silence rather than a written refusal, so a refusal-based trigger leaves you with no event to point to while the advance payment stays where it is. A deadline fires on its own.
Two further points. Ask for a termination right with a refund obligation rather than declaring the contract "void" — voidness is a different legal concept, its effect depends on the governing law, and it can take your own remedies with it. And a refund promise is only as good as its security: back it with an advance-payment guarantee or escrow, or avoid the exposure altogether by tying payment to license issuance. In a seller's market for a controlled item you may not win this clause at all, in which case the risk is being priced into the deal rather than allocated by it.
Strategy 4: Match Incoterms to the Risk
Incoterms decide less about license risk than is commonly assumed, and two habits are worth correcting.
Because export clearance sits with the seller under every rule but EXW, the Incoterm is not the instrument that allocates license risk — an express contract clause is. Strategy 5: Diligence the Upstream Supply
Even a stable finished-goods supplier leaves risk intact if the raw material it uses is controlled. For instance, you need to confirm whether a ScSZ finished-goods maker has secured a stable scandium supply and how the license track for that raw material is designed — only then is real supply stability assured. Extending the scope of diligence one step upstream, to the raw-material supply, is what makes the difference under export controls.
Vendor Due-Diligence Checklist
The minimum items to verify when qualifying a new supplier:
- Business registration and legal entity verification
- Quality system certification such as ISO 9001
- Production-capacity evidence (equipment, lines, annual capacity)
- Video or on-site audit
- Track record of obtaining export licenses (especially important for controlled items)
- Trade references and willingness to support third-party test reports

Frequently Asked Questions
In practice, how does licensing differ from an embargo?
An embargo blocks supply outright; licensing allows supply once review is passed. So under a licensing regime, "getting the license approved" is as valid a strategy as "finding an alternative." Their feedstock may also be Chinese scandium oxide, in which case the exposure has only moved upstream. Rather than relying on a non-China line alone, combine a price-competitive China line (license track) with a non-China line, verify feedstock origin on both, and balance total cost against supply stability.
